(a) These Terms and Conditions together with any additional provisions, such as the Privacy Policy, govern your access to and use of the services and products on our website (JuiceCulture.com.au). The website is operated by Juice Culture (ABN 19 376 529 474) of 20 Woods Road, St Albans Park, 3219.

(b) In these Terms and Conditions, “us”, “we” and “our” refer to Juice Culture (ABN 19 376 529 474) and references to “you” and “your” is to you, the end-user, consumer, or customer.

(c) By accessing the website as well as ordering our products, you confirm that you accept and comply with these Terms of Conditions. Juice Culture reserves the right to alter or adjust these Terms of Condition at any time. There may be a need to adapt the Terms and Conditions to align with new legal requirements of the Laws in Victoria, Australia or new features or offers made by Juice Culture. As far as legally required, we will inform you about such amendments.

(d) The collection and use of the personal data which you provide are subject to our Privacy Policy. By accessing, using, subscribing, or making an online purchase through the Website you consent to the collection and use of the Data by Juice Culture in accord with the Privacy Policy.

(eThe use of the website and the purpose of the contract between you and Juice Culture are exclusively governed by the Term and Conditions and the Privacy Policy of Juice Culture. Any contradictory or deviating terms and conditions will not apply.

2.1. Information on the Website

(a) The website comprises information regarding products and services of Juice Culture. We reserve the right to amend product ranges, adjust prices and technical changes at any time. All information on the website (images, illustrations, icons, product descriptions, product features, packaging, technical specifications, supplies, labels, courier company and other information) are to be understood as a basic guide and do not always represent or guarantee a feature of the product or service unless explicitly stated. Juice Culture endeavours to always present precise, accurate information and data on this website, however, Juice Culture does not claim to be binding. 

(b) Product availability listed on the Website are subject to change without notice depending on capacity limits and Juice Culture discretion. 

 (c) Juice Culture cannot guarantee that the listed products are available at the time of ordering. Therefore, all information on availability, delivery days and delivery areas are to be understood as approximate and without guarantee and may change at any time and without notice.

 2.2. Ordering and Establishment of Contract 

(a) The Juice Culture online shop presents customers with various beverages and related supplies (products). 

(b) By clicking the “pay now” button in the Juice Culture online shop, you as the customer place a binding order for the products in your shopping cart. Only Juice Culture reserves the right to process a refund or make amendments to the order after an order has been placed. 

(c) A confirmation receipt is sent electronically to the email address submitted by the customer. Although Juice Culture will do its utmost to supply the product ordered, however, Juice Culture reserves the right to refuse fulfilling an order without giving any reasons. Generally, the reason for Juice Culture deciding not to fulfil an order is due to product availability, estimated delivery impacting the quality of the product or for an undisclosed reason. 

2.3. Delivery 

(a) The customer has the option of checking if delivery service is available in their area by using the “postcode checker”. Where no information is given, you can contact us

(b) Any agreed delivery dates cannot be guaranteed. Should Juice Culture miss the assigned delivery day, the customer may not withdraw from the order. Juice Culture will not be liable for any damage caused by the delay.

(c) The goods are delivered by nominated courier services to the delivery address provided to Juice Culture when the order is placed. We do not issue refunds or resend orders that are not deliverable due to delivery addresses being entered incorrectly. The address must be checked at the time of ordering. If there is a discrepancy, it is the customer’s responsibility to amend the delivery address before dispatch.

(d) The customer is responsible and takes the necessary measures to ensure that the delivery is personally received by someone at the delivery address on the selected date. Should this not be the case, the parcel will be left at the address at your own risk. Once the parcel is left at the address, it is deemed delivered. 

(e) The customer accepts the responsibility when purchasing that Juice Culture products are perishable and requires immediate refrigeration once the order has been delivered or picked up. 

 (f) Once delivered or picked up, Juice Culture is no longer responsible for mishandled juices.

(g) Once the product arrives at the delivery address or is picked up, you agree to take on the risk for the goods, incurring any loss to damaged or stolen products or packaging.

(h) Orders are to be inspected upon reception of delivered products, if the product is defective, damaged or if you receive the wrong product contact Juice Culture immediately within thirty minutes from delivery time or pick up time. Juice Culture will evaluate the issue and decide what action to take. A refund or replacement of the defective item in whole or in part may be issued. Under no circumstances will Juice Culture be liable for any cost, loss or damage caused by a delay in delivery, including incorrect delivery details provided by you.

(i) Juice Culture reserves the right to refuse delivery if the delivery address is outside the valid delivery area. We will inform you when ordering the goods if your address cannot be delivered. 

2.4 Refrigeration and Consumption

(a) The products delivered must be consumed according to the expiration date recorded on the bottle unless explicitly informed otherwise by Juice Culture or consumed in its entirety within 2 days after the opening of the bottles. 

(b) Once the products are delivered or picked up, the Customer is responsible for creating the conditions to preserve the products by refrigerating all the products at 1-4 degrees Celsius immediately after delivery or upon collection.  

(c) Juice Culture does not take responsibility, nor will Juice Culture reimburse the customer for any change to the quality or taste of the product due to the strict refrigeration requirements not being met by the customer penned in Section 2.3. A suitable arrangement must be made by the customer to refrigerate all Juice Culture products immediately after the order is picked up or delivered.  

  1. Health and Medical Disclaimer

(a) The information on nutrition and health contained on the Website and other areas such as our labels and pamphlets and emails are intended solely for the general well-being of the customer and does not constitute medical advice. The information provided by Juice Culture does not replace professional medical consultation and advice from a doctor or medical professional.

(b) Juice Culture products are raw and unpasteurised. Juice Culture is not responsible or liable in any way for your health and nutrition. Please consult your doctor if you have any health concerns or specific questions regarding your nutritional requirements that may influence your health or pre-existing health condition before making an order.

(c) Our products do not replace personal advice from a qualified nutrition expert. We cannot guarantee specific nutrition or dietary requirements be met. We do not make any health claims that the use of our products will deliver a specific result such as weight loss. Although we publicly share anecdotal experiences from our clients with the Juice Culture community, however, customers must accept that results and experiences may differ from person to person. Juice Culture is not responsible or liable for customer expectations not being met. 

(d) Our products are manufactured in a facility that handles nuts. For this reason, some products may contain traces of nuts, although not stated on our labels. We do not hold any responsibility for allergies or anaphylactic reactions from consuming any of our products. It is your responsibility to inform us if you suffer from any allergies or major health conditions before placing an order. 

Refund Policy 

Damages and Issues 

Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Refunds

If you receive the incorrect juices please let us know immediately and we will refund or replace them.

The customer accepts the responsibility when purchasing that Juice Culture products are fragile and must be refrigerated after the product has been delivered. 

We do not issue refunds for or resend orders that are not deliverable due to delivery addresses being entered incorrectly. Please check the address at the time of ordering. If you notice a discrepancy, simply contact us so that we can amend the delivery address prior to dispatch.

Once delivered we are no longer responsible for mishandled juices.

Returns

Due to the juices being a fresh made-to-order product, returns are not possible.

If the item is defective, damaged or if you receive the wrong item please contact us immediately and we will assist to resolve the issue.

Change of Mind

In the event that the customer changes their mind about a product they have ordered online, Juice Culture has the right to determine if a refund can be issued. A refund can be issued if the following criteria are true:

- Produce has not yet been purchased by Juice Culture that is required to fulfil the order.

- The order has not yet been pressed.

If this criteria is not met, Juice Culture has the right to determine if a refund can be issued.

Please note that Juice Culture can refund 97% of the total order cost. This is because 3% is taken by Credit Card or PayPal fees. These are funds that have been taken from Juice Culture and are not refunded from these merchants.
